Then they take blood...but how can they forcefully take blood i mean its your blood?

  1. They legally can't force you to do either one. BUT you WON'T get the benefit of the doubt when you're in a court of law and they have to decide whether you were legally drunk. You WILL be found guilty. You can't get out of you're punishment simply be refusing to give a test that will determine your Blood Alcohol Content at the time you are arrested.


  2. I just had a DUI arrest. Never blow NEVER. its just one more piece of evidence against you. I received the standard fine and lost my license for one month.

If you refuse to take a sobriety test you may be susceptible to have your license revoked as they do here in Florida.  Plus, if you refuse a test it will only count against you when you go to court.  If you were a judge and some kid sat in front of you swearing they were not drunk...but refused to take a breathalyzer test...doesn't that make them look very suspicious on that account?  What were they hiding?  If they want your blood for a test they simply admit you to a hospital under supervision of the courts.  You have rights...but don't get too excited over them.  Your rights can be  'flexed' for just cause, or probable cause.

  4. They can not forcefully take blood.... and you have the right to refuse a breathalyzer test. I used to be, uh, quite the "wild child", and all of my friends  got out of DUI's with minimum punishment because they refused to take the breathalyzer.

  5. if they have to they strap you down and put a needle in you.  By not taking the breathalyzer you are agreeing to let them take your blood.  It is written into law in the places they do that.

    Just as signing a traffic ticket is to release you from being arrested - if you refuse to sign a ticket promising to go to court or pay the fine, then they take you to jail.

  6. Ah, I don't think they take blood forcefully.  Unless it's some twisted law in your state.  You have every right to refuse taking a breathalyzer test, but not taking one is automatically an admission of guilt, and they will charge you.

  8. Here in Alabama if you refuse a breathe test then you automatically are arrested and ticketed. You will have to do the 48 hours in jail and then see the Judge to give your story. The arresting officer has a movie of your arrest and condition.

  9. They seize it.  They get a warrant to seize your blood from the magistrate.  The magistrate signs the warrant and boom, you are at the hospital.

  10. Well I am not sure hope it works where your from but in California you have the right to refuse to take the test but by doing so you will be arrested for obstructing justice and they will try to get for being intoxicated.

  12. The law is the government. The government rules all. lol. Not very often do they force some one to do so. Usually if you refuse either its harder for them to have a case against you. Because there was really no proof. So thats why they do have a warrant for a blood test some times.

    i live they can get a warrent for your blood but in some other state if you do refuse you might can beat your case
