  1. They will go thru the regular eviction proceeding.  How long this will take varies greatly, some places it can be 6 months, and others as little as one month (about 2 months where I am, which seems average).

You can also ask the bank if they are willing to pay you to leave (called "cash for keys") and they may give you a few weeks rent just to get the place back sooner.

Oh, and they may give you an additional amount of time (maybe 30 days or so) before they even start the eviction process, but they may not (sometimes a judge will force them to give the occupants some time before they can start the eviction).

  2. the landlord is obligated to give you 30 days here in GA so I assume it would be about the same elsewhere.

  3. It depends on the state, if you are in this situation you need to consult a lawyer, legal aid or a tenant rights org

    for a broad overview

  4. Should be 30 days.

  5. So the landlord got foreclosed on.. correct? There is no set amount of days per say. I have personally seen banks take up to 6 months before they start proceedings on the tenants left in the property simply because of backlogs. It depends on how efficient the bank is.

I would say as a "good rule of thumb" - you will have anywhere from a week to 4 weeks before you get notification from the bank. When they come out, they will typically hand you a 30 day notice to vacate but they must be at minimum standard for the state.
