If you are banned from xbox live for modding your console could you still download demos and extra or updates?

No because when they ban you and your console, they will also brick it making it impossible to play.

When you get caught with a modded console, you get banned with no questions asked.  This means no access to xbox live until you do two things.  First of all you need a new xbox because xbox live will know your old console is modded no matter what new profile you buy.  Secondly, you need a new gamertag since the old one was banned.  They have been very strict on this ever since the wave of modded original xbox's back when Halo 2 was king.
