If you are dismissed for gross misconduct does the employer have to pay the rest of your holiday entitlement?

  1. no-if you are dismissed for an act of proven gross misconduct the employer has the right to dismiss you without lieu of notice or pay (this includes holidays not yet taken)


  2. Yes, you are entitled to holiday pay in respect of all untaken leave due at the termination of your employment. Go to a CAB office. They will help you write a letter of grievance, which is essential, and may represent you at a Tribunal if that proves necessary. You must lodge your application with the Tribunal within 3 months of the last day you were employed.

  3. yes they must pay you for any holidays you have earned, they are yours and they must pay you

  4. No they do not have to pay holiday pay unless the holiday is actually taken.  Even then it depends on the contract you signed when you first started.
