If you are in a wreck in Tennessee and do not have insurance, does that make it automatically your fault ?

I slowed down to pull over for a police escorted funeral and was rear ended by a careless driver. I did not have insurance at the time of the wreck because it had lapsed. However I did get insurance before the police arrived. I got a ticket because I didnt have proof on me. Does that excuse the other driver who hit me according to Tn law?

  1. No, it does not excuse the other driver - it does NOT make the accident automatically your fault.


  2. No !    You will be covered.  Getting your car fixed by an at fault driver does not require that you be insured.  How could you get insurance "before the police arrived" ?

  3. How did you get insurance before the police arrived (on your cell phone?)?

    The problem with not having insurance is that you have to try to get your money from the other insurance company with nobody working in your favor, or you have to provide your own defense if the other party tries to sue you.

  4. No the other driver was still responsible for the accident. You were ticketed for failure to meet the requirements of the state financial responsibility law.

  5. No. You may be a fool for driving without a license, but you aren't at fault for this accident. The person that hit you was following too closely.

  6. the person who rear ended you is at fault and should pay to repair your car.  how did you get a polciy in force before the police came?  i dont know of ANY company or agency that would insure you at the time you had an accident....
