If you are in california and the tenant are not paying for rent. What do you do?

what ways are there to make the tenant pay and what are the ways to kick them out? if you are going to court and the tenant is claiming that you have not fixed a window for them but in reality you did, but you did it yourself so that there is no receipt of proof. what do you do then? can you and your friend be at the court saying that you guys were the one to fix it? what are the chances of winning then?

  1. Chances are that you will need a lawyer.  There some that do nothing but evictions.  They advertise in the Apatment Owners Association magazine.  You can contact them at WWW.AOAUSA.com

    You do not have to wait until they are a month behind in the rent.  You can do it the very next day after the rent is due, although most places will give you three days without any penalty or starting eviction proceedins

  3. The Tenant has to claim that a major problem was not fixed. I still say go to court to start the eviction notice. You have proof rent was not paid. Just make sure that you made several attempts to collect first so that the tenant can't say they never were able to locate you to pay the rent. I would take someone as a witness. If you call them...save the recordings of the calls made.You also must make sure the rent is more than 1  month behind before you can do anything.

  4. If your residents have not paid rent and they are past due, you need to serve them with a 3 Day Notice to Pay Rent or Quit. Once they are served, if they still have not paid after the time is up, you then file in small claims court which will only cost a small fee. Should they lose in court, they pay not only the rent's owed but also the fee's and court costs. Here is the best advise your going to get: 1. Learn the law's in CA if you are going to rent out your property. 2. Pick up the phone and call HUD, Housing and Urban Development or ask information for your local Housing Authority. Call them, they are there to help residents and landlords alike with any question's they have. If you have fixed the window, you must either have a receipt for the window you purchased or take a picture or have a friend go to a notary and sign a statement that you did indeed have the repair done.

  5. Why are you managing your own rental. Hire a reputable rental agency for 8% of gross rent and let them deal with it.

    Don't be cheap with an investment you could wind up losing it because of lack of experience and knowlege.

    There are alot of low lifes out there that know exactly how to play the system. If you do not know the laws that protect you you're in trouble.

    Most laws in California protect the Renter. Contact RESPA they will advise what you can do.

  6. If they haven't paid rent serve a 3 day pay or quit.  If you really want them out don't accept any money not even back rent.  Once the 3 days is up start the legal eviction process once its all over take them to small claims to recover all un paid rent and cost of eviction.

    Obviously they are still in the unit and you say they are claiming a window wasn't repaired drive to the residence and take a picture of the outside of the building.

    Just because the landlord fixes problems that need to be repaired doesn't mean anything you dont have to hire outside help to install the new window but you should at least have a receipt for the purchase of a new window.
