  1. If it is the others insurance or the other person, Yes, they still have to pay you.  If it is your insurance company who is paying, then no, you cannot just take the money.


  2. NO, they NEVER pay you.  They have to pay to fix your car.  The money should go straight to a repair shop, not the owner of the damaged vehicle.  If you want to negotiate with the insurance company to have them purchase the vehicle from you instead of fixing it, you can do that- but you give up title.  And the damage has to be greater than the car is worth.

  3. If you collect from the other person or their insurance company you can take the money and not get the car fixed. They still have to pay you no matter if you get the car fixed or not.

    If you collect from your own insurance AND you have a loan on the car, then yes the loan company can make you repair it if you collect from your own insurance.

  4. Well, I cant imagine a person would just give you cash with out calling the police for a report to give their insurance company. But, if you get a report filed and decide not to use the money for the car that would be on you if the insurance company wants to see the work. Once you get the check it is up to you to do what you wish.
