I live in Phoenix Arizona and I work for a flooring company, I am responsible for answering the phone doing customer service taking leads and gathering lead statistics for each day. I am paid 520 dollars a week and the salary is for 46 hours when I work 50 hours a week , I work approximately 8 -10 hours a week that im not paid for. Do I qualify for overtime under the law in arizona? If so how do I collect when my employer refuses?

Thanks!

  1. This is covered under federal labor laws. In general, salaried employees are exempt from receiving overtime. However, there are very precise rules governing who can be exempt. It depends on your job duties.

Click on the link below, and then click on the Fact Sheet called "Overview for Executive, Administrative, Professional, Computer, & Outside Sales Employees."

It is a fairly common trick to put an employee on salary to avoid overtime, even if they don't meet the test for exemption.
