If you back up and you hit the car behind you...and you have others in the car and you hit and run...?

  1. It depends.  Did you signal that you were backing up before actually throwing into reverse?  Was the car far enough away from yours, and it moved toward you as you were backing up?  Was the other driver not paying attention?  If yes to any of these questions, they may or may not be held accountable.  Being a good driver is being a defensive driver.  When you were backing up you should have been paying attention to not only what you were doing, but also to what the other car was doing.  (I say this from experience, i was passenger to an accident that was not 'my' drivers fault, but the person behind us.. and 'my' driver was sued).  Either way though, whether or not it was your fault/their fault - you have shown that you are 'guilty' in a sense because you did a hit and run.  Hit and runs always incur more problems than staying in the situation and getting it dealt with.

Laws vary from state to state.  In ohio, the others are not at fualt  because they never had physical control of the vehicle.  Also, you may have a period of time to report the accident.  Here in ohio, you have 24 hours to report an accident, so until the 24 hour period elapses, you can only be charged with leaving the scene which is a misdemeanor.

  8. Anytime that you are backing out or reversing a vehicle and hit something or someone it will be your fault and if you leave the seen, yes you will be charged with a hit and run...........
