If you car insurence does not cover your passenger but the passenger has health insurence, would they be covered? Is it more risky to say that the person im driving withhas helath insurence and I get into a crash and both of us gets hurt and im covered and hes covered with his health insurence is that more risky or just as safe?

  1. In the UK, it is illegal to drive without third party insurance, and a passenger is a third party. If you have an accident, they can claim under the third party section of your policy if they are injured. If the passenger did also have health insurance which covered that sort of accident, they would not be paid out twice, as that is illegal. Usually, each insurer would pay half of the claim.

    I would clarify the cover for passengers with your insurer and if they are adamant that your policy does not cover that, I would consider leaving them as if you were to seriously injure or kill a passenger and you do not have adequate cover, you could end up getting sued for a fortune.


  2. Confusing question. What you are asking is not clear. If your insurance does not cover a passenger when you are driving, in my state of WA, that is against the law. I would suppose the passenger's insurance would cover him, but then his insurance company would turn around and sue YOU to recover the costs they paid as a result of YOUR accident which injured the passenger. Either your insurance company pays, or YOU, personally, pay.

  3. i do not know of any policies that exclude the passenger.  you are driving, not the passenger.
