Question:

If you don't have a name for the father on a birth certificate can the person youre getting married to adopt?

Okay well they need to make it so you have more characters to work wih. I am getting married in march to a wonderful guy in the military and he wants to asopt my son how would that work out can he just ouright adopt him? Or what would I have to do?

  1. As long as you list the father as unknown I don't think you are required to get a relinquishment.  Each state has their own laws though.  Tell him to talk to the legal department on base.  They can help you guys find out what you need to know and how to go about the adoption process.


  2. technically i think he can adopt him. if you are in military you just go to lawyer on base and get it done. should be nearly free i would think.

  3. Yes, your husband can adopt your son. You can use a private attorney. In some states, you may be required to post a notice in the paper regarding the adoption as "legal notification". In some states, you may be required to contact the father to request that he relinquish his rights (very few states, I believe).  

    In many states, if the father didn't sign a "Putative Father Registry" claiming the son as his own, he is not the legal father.  Check the link below.

    Another consideration, depending on the age of your son - if the bio-dad has had no contact & provided no support for a year (or more), most courts consider that legal abandonment & may terminate his parental rights.  

    A family law attorney can answer what exactly you'll need in your state.

  4. Talk to an attorney who handles adoptions.  They will be able to tell you the route you need to go on this situation.  Once all the options are covered, I don't see why your soon to be husband couldn't addopt the child.

  5. well i was 16 when i got pregnant from a no good kinda guy that  didn't want anything to do with me or with the baby i was caring

    so i moved out of state and never contacted him again nor did he try to contact me so there was no fathers name on the birth certificate but when i was 2 months along i met the love of my life we got married 2 months after the baby was born and now my son has been adopted by him and he got a brand new birth certificate with my husbands name as the father

    we went thro a lawyer and paid a pretty penny so we wouldnt have to do any paper work other then read and sign other then that i dont know how you would do it but our lawyer did all the paper work and set the court dates we met him to sign the papers then went to court and it was final
