If your payments are current and you qualify for a chapter 7...yes...you would file and include in the bk, but re-affrim on the loan to continue to pay....If you don't qualify for a chapter 7 and qualify for a 13 instead, you could run the payments thru the chapter 13 plan....if they are not current the chapter 13 will allow you to run thru the plan even though behind on payments.  Good Luck!


  2. If you exclude it from the bankruptcy.    If you are in foreclosure you need to pay the arrears.
