consider a felony, my friend married this kid after knowing him 6 months he got in trouble he was here on a school visa he graduated, they want to know why he is still here, all of the charges they got him on are expunged from his record, her parents are sponsoring him, but they were told today that they don't make enough money.

OK there seems to be some problems with ur question which is than you do not say in what kind of troubles was he involved !!! i mean if he was charged with anything considered turpitude ( please google it ) then he could be banned because of that . second , u talk about a lawyer but u do not mention what kind of lawyer was this ( certified immigration lawyer or not ) .... well anyways from what u did explain there seems to be another problem and that being than he did got married after the troubles ,  so yes that could lead to another problem which could be than depending in what he can prove or cannot prove he could be charged with trying to create a sham marriage if he isn't able to prove than he did not got married just to be able to stay .

    He may have to return to his country and wait until he is allowed to come back in.

    As for the sponsors (parents) not making enough money, the boy can get a job to support himself once he legally returns (so it's not a burden on the US, or his sponsors).

    He was probably under 18 years of age, so his records were not publically released, and expunged.

If there are charges on your friend it will definitellly jeopardize the legal status, if u go either on Tourist or Student VISA it does not take much time for him to be summonned to receive a notification to leave the country in case the charges are not dropped, anyway INS will review his status and of course if he is meeting the requirements still. If he got married with an american lady then he needs to hire a lawyer from the same state were the problem was originated and clear it off at the same time he needs to change his status of immigration to resident because that is given once you get married with an american, then he wll have to wait between 3 to 5 years to receive or not his american citizenship.

  8. Welcome to a free ride home for him and a ten year ban from entering the USA. If you are in the USA without the proper documents (expired visa is not a proper document) then you have committed a fourth degree felony.

    Sorry that is not meant to be a cocky answer just plain fact. I received training in this because as a boarding officer for the US Coast Guard on some of the big yachts we get this kind of problem. People who are coming back into US waters after they have incurred a mandatory 10 ban upon entering the USA. I do not know the ins and outs that the lawyers go through to get around the law I just got paid to enforce it the way I was told.

  10. Marriage to avoid deportation is immigration fraud. It is presumed that getting married at that point is strictly to avoid deportation and is a "sham marriage". Both parties are presumed guilty of fraud.
