  2. Generally not.  It would certainly depend on the reason for which you are being evicted.  However, if the landlord expends money on the eviction process, he is entitled to deduct that from your deposit, as well as for any unpaid rents and damages.

    If the total sum of those expenses exceeds your deposit, you will not only not get it back, but will probably be taken to small claims court for the difference.
