If you get pulled over by the police and you dont have your driver license on you?

does the police have a right to search your vehicle for drugs and firearms? and call k9? to me i think they should have gave a ticket not all of that! who knows the law about this?

  1. You have every right to deny them access to your vehicle.  If they don't have absolute reasonable cause or a search warrant then they can't search your vehicle.


  2. no if they did not get consent from you they are not allowd to check your car they probably said may we search your car and you said yes otherwise no

  4. No they can't because that is NOT probable cause........they should have had another reason, idk if you'd want to fight it because it's you're word against a cops(although you didn't specify if they found anything so that would end up playing a HUGE role in the whole thing)

    and IDK if you're asking about this but if they pull you over and you don't your license on you then they usually charge you with some form of infraction and you should have been able to either go pay the ticket or schedule a pre-trial conference and have been able to show the judge that your license was valid on the day that you got pulled over and should have dismissed it (atleast thats what tehy did to me!)

  6. You give them your info. If they give you a ticket for not having it , you just go where ever it is that you have to pay it and show proof of your license. usually you you will still have a small fine but that's it.

    btw, i didn't get the ticket, cuz i told the trooper i was going to be late for class.

  11. You are required to have your driver's license at all times while driving your car. That's what you are supposed to be told at some point. They can search if they feel you have something that you shouldn't have, as you don't have something on you that you should have.

    I do however believe the whole k9 thing is a little extreme, but maybe someone called in and described your car. If it's a random search, they did go a bit overboard there. They're cops, though. They do that a lot.

    Your situation can be a tricky one. No license, they own the car. Licensed, but not in possession, they could get "creative".

    The police do have a right to randomly search your vehicle whenever they want, its stupid i know, but thats just the way it is.

This all depends on where you are pulled over, who pulls you over and what you were doing that caused you to get pulled over.  I forgot my license at home one day and was in the neighboring state visiting my daughter and was stopped for a tail light that was out.  I started searching for my license and started to get very nervous and frantic when I realized I didn't have it.  The officer asked for my registration and went back to the cruiser to find out information on me (they can also find out if you have a valid license) since the registration was in my name.  He returned and I was still searching but was so upset because I knew by that time I didn't have it.  He simply handed me back my registration and said don't worry about it, but you  do have a tail light out and need to fix it.  Since I had 150 miles to travel to get home he said I will call ahead and let the department know I have already talked to you and he left.

    If I had a car full of teens and was younger it might have been a completely different scenario.  It isn't right but this is often the situation.

  15. It can lead to reasonable suspicion and probable cause. So yes they can search your car if you fail to carry or produce a license. Driving is not a right. Because of the nature of a motor vehicle they can detain you for a reasonable amount of time to check you and the vehicle out.

    Sorry about what you think but that is what the courts think.

  17. They can only search your car if they have a reason. As to not having your license, I'm not sure. It may have something to do with you live.

  18. Cops always think they're above the law. If there is no probable cause, they'll just make something up. I was stopped in Georgia because I had a black person in my car. The cop ended up interrogating both of us - asking what a white person is doing with a black person, where we were coming from, where and why we are going to........ etc....and searching the car. The bogus reason for the stop? Illegal Window Tint! I made sure it was not illegal before I bought it. On two separate occasions I had cops search me - sticking their hands in my pockets etc....



  19. The fact that you cannot show who you are allows them to be sure that there is nothing else going on.  People who know they are wanted  will not often hand over there ID.  

    It's on you for not having license on you.  And think about it, the cops should let every operator with no ID be on there merry way without being checked out?   Drug dealers would love that!

    Your rights were not violated.  You were inconvenienced.  

        

  20. no they have to have a search warrent to search your car!! Ive got pulled over for speeding and didnt have my lic. they just told me to bring it in when i payed my fine LOL......they pulled you over for a reason not to search ur car!!!

  23. Yes, they have a right to search anyone for drugs and firearms.  It's at the officer's discretion.  They usually only do it if you look suspicious though.

I am not aware about searching the car, but one day i was in a hurry to get somewhere and forgot my purse. an office pulled me over and asked for my DL and Ins card (which both where in my purse). Its a law here to have ins and to be able to show proof of such. The officer was kind enough to call state farm so i could prove i have ins and than told me to i could come to court and show i have a DL. Now i carry my ins card in my glove box and purse.

  28. In most states you have to go to court to prove you had a valid driver license at the time you got puled over.  some times they can just look it up if you give them a DL number.

  30. You will be ticketed for driving without a license, the vehicle will be towed to impound, and you may get a ride home in the cruiser with a licensed officer. Suspicion alone does not justify a vehicle search, unless it is obvious.
