If you had a defimation law suit against someone would you sue?

I was publicly slandered through a message board, from someone I know. They comments they made are complete lies and there is no way she could prove it. If you had the ability to sue someone that you know but is not a friend would you? They are not financially well off so chances are the best I would get is a written apology that is made public. I think this would be more valuable anyways.

  1. You have to establish damages --provable in court. A tort attorney can advise you if you have a case.

  2. Absolutely not.  People like that are not worth my time or effort.  Explain to your children and let them know you love them and it does not matter what anyone says about you.  You are you and it is not anyone's business.  Ignore it!  Enjoy your life and your children.

  3. No - I would not sue because it is such a hassle and I hate having to deal with lawyers etc.

  4. Id say the courts are abused enough as it is. Id say you should just get ovet it. However, i think that if they are in fact malicious lies and you could prove that the person worte the comments, you could probably win. Its a lot of trouble though. And your right, you probably wouldn't get much more than an apoology

  5. Last time it happened to me (2001, statute of limitation has expired), I cut all four of the guy's tires on Miata.  Of course, this was not the BEST course of action I could have taken, but it definitely was the most satisfying.

  7. A defamation law suit would never result in a written apology or a public apology.  A civil court would not make an order like that.  I would say move on.  I don't know what the comments were, but if they are opinion, it's not slander.  If it's based on truth it's not slander either.
