I know someone who committed what I can figure is a gross misdemeanor (based on researching the law in my state). I am not friends with this person, he is a coworker of my husband. I have no loyalty to the person and don't even really like him- but my husband is seriously conflicted because he is his friend and doesn't want to be the one to get this kid (he's only 18) possibly thrown in jail. We both are feeling pretty guilty about knowing about any of it (he told me because he doesn't keep stuff from me, thankfully).

I'm just wondering if we could get into trouble legally for NOT telling?

  1. yes you can get in trouble if you are withholding information.

  2. If you are helping him in any way, yes....If it is not a felony and no one is being hurt right now from it, then you are OK.

If it is your spouse, you are not required to talk, as per constitution of US.  If it is your kid, I would, but still you are protected, unless one of top two situations exist.

TIP: call the police and report it anonymously; they will not ask your name and you can even get money in most states.
