  1. No but it will be repossessed if they find it as well as the fact that it is killing your credit.

No I  dont  think  so, unless  it was a rental  car  that  you failed  to return, That  would be unaouthorized  Use of a Motor  Vehicle  under  NY state law.  If  you puchased the car  and havent made  payments, then its  your  car, but it can be repossssed by the lein holder,That  is a civil matter, not criminal,as in the stolen car.
