Question:

If you hit a softball into a moving car who pays and is it technically a car or homeowners insurance claim?

I hit a foul ball on a universities intramural fields. The ball bounced off a sidewalk over a parked car and into a car driving ~15 mph. Who would be considered responsible for the damage? And if I am responsible then would it be a car insurance claim or a homeowners insurance claim since it had nothing to do with my car? What if I don't have homeowner's insurance because I don't own a home? There was no police report filed and only my phone number was exchanged does any of that make a difference?

  3. It is an auto insurance claim.  You will not owe for the damage.  The vehicle owner's insurance will pay for the damage.  Some states do not require a deductible for glass claims.

  4. The automobile's comprehensive coverage should handle repairs, although you may be approached to pay for damages.

  5. Is it a state university, or private?  It matters.

    See, if you hit the ball, and the driver wants you to pay for the damage, it's going to be YOUR HOMEOWNERS, or your parents' homeowners policy, that would pay for that.  

    If the driver doesn't know who hit, he could ask the school to pay for it, or file under his comprehensive coverage.  

    If the university is private, they might be on the hook for it. If it's public, they probably aren't, due to "governmental immunity" laws.  

    Ultimately, though, even if you don't have insurance, this guy could sue you in small claims court, and will probably win.  So you'll have to pay, if you have no insurance.
