If you hit someone during a car accident, and they claim they have neck tissue damage...?

how much can they possibly sue you for? Are there other circumstances?

  3. theres no set amount for how much you can sue for. however it all depends on your settlement, but if you dont settle it will be up to the judge to decide the amount. usually its the cost of medical bills plus pain and suffering. since you hit them while you were drunk theres a good chance they are gonna get what ever they ask for...

    This is one reason to carry good insurance, tell them to call the claims agent for your insurance company. Under no circumstances try to negotiate with them.

    Most insurance companies can afford better lawyers then you can  and the cost is part of the premiums.

The can sue you for whatever amount they want to.  However, that does not mean that they will settle for that amount.  I have seen plaintiff's file lawsuit in NY for simple soft tissue injuries, and the amount of damages claimed is in excess of $1 million.   Obviously, I do not settle anywhere near that number.  Assuming the injury was more than just a soft tissue injury, they most your insurance would pay out is your policy limit.

    Refer the matter to your insurance company.  If in fact the other party meets the threshold requirements, the adjuster will secure all the supporting documentation.  Once received they will settle the claim based on the nature and extent of the claimant's injury, treatment and disability.  Adjusters evaluate claims for a living.  They know how to settle claims, and will do everything possible to settle the claim within your policy limit.
