If you leave the property before the court date is eviction on your credit report?

I moved out of the appartment but I didn't get all my stuff out or turn in keys. If I get the stuff out before the court date, technically, I wasn't evicted I broke a lease. Right?

  1. The eviction will still proceed...especially if you owe money.  The court will not proceed with the vacate order (since your gone from the premises) but the court will order a judgment for any back rent, attorney fees, court fees & damages.  This will go on your credit report and can be collected through wage garnishment, liens, bank levy....etc.


  2. An eviction is on your credit rating unless the landlord dismissed the case because you had vacated.

  3. If you've been served eviction papers, you've been evicted.  If you break the lease before you're served eviction papers, they can still s***w your credit up, but probably not as bad.

    Don't rely on any info you get from here to base your decision on, though.  I'm not a lawyer or anything, just a guy who was evicted from his apartment a long time ago.  It'll stay on your credit report for 7 years as a judgment against you, so if it's possible to avoid it, do so.
