If you pay off a lease, and the landlord rerents the property during that time, must he reimburse you?

We are a relo company, paid a lease off till May and he rerented in Feb. Isn't that collecting double rent?

  1. Yes this practice is not only unethical, it is illegal. You may also want to file a police complaint for trespassing. Technically, you are still the tenant until May-regardless of actual occupancy.

    File a small claims suit and a Discovery Motion for the new tenants lease.

  2. It is double rent and is not allowed. He can only collect for the period the property was not rented.

    You are entitled to a refund.

  3. Yes it is, and you need to send him a certified letter, telling him you are aware of the re-rental.

    I would give him a 14 day notice to pay you or you will sue.

    If you sue, you will win.

    He CANNOT double collect.  That money was to reimburse him for LOSSES to "make him whole"...so from February to May...he's in a better position than he would be in before, the courts won't allow that.

  4. If you paid off the lease to get out of your contract, then he can do what he wants with the property - you've walked away.

  5. Read the lease agreement....I think it should state you are responsible to pay a fee to break the lease or what they call a re-renting fee and will be responsible ONLY for the months that the apartment is vacant. They should reimburse you for the 3 mths.
