If you run into some ones car while rideing a a bicycle and take off is a hit and run?

If a person is under the influence of alcohol and runs into a car causing damage while riding a bicycle and takes off. Can that person be charged with a hit and run or will He just have to to pay damages.

  1. Bicycleists have to follow the rules of the road.  he must stop and exchange information like any vehicle operator.

  3. Since its not a motor vechile you could be charged with damage to personal property. Since you did damage to others property you are responsible.

  4. depends on them. They can drop the charges or charge you to the fullest. And it really depends how much you damaged the car.

My dad, bless his heart, does not drink and drive (or bike ride), but he does love to ride his bike.  He has, on at least two occasions, gotten distracted in traffic and crashed; once into a person' car, and another time into a telephone pole.  On the first occasion, it was a convertible, and my dad was thrown from his bike and, literally, ended up inside the top-down convertible.  The second time, he smacked headlong into telephone pole, damaging his bike and knocking himself out.

    My point being this: If a bike rider hits a car severely enough to damage the car, you can be sure the bike and rider will be too damaged, himself or herself, to just ride off.

    BTW, neither the convertible nor the telephone pole suffered any damage when my dad crashed into them.

  6. well it would probably be a hit and run but if the person who owns the car just says to pay to fix it then they wont arrest you or anything

  7. Not only is it a hit & run, Impaired on a man powered bike in NC is charged as an impaired driver. D.W.I., same as a vehicle !

  8. In NYS it is property damage/leaving the scene among other things.

    DWI-bicycle? No, not really however, creating a disturbance, being too drunk to be in public....
