If you sued a insurance Company on fall accident,?

And there where more injury's found.And you signed a release form. But and your attorney did not sign his signature on the release form.Could you proceed for more damages on the Law sueit? I already received money on the case already?.....

  1. Check with your attorney.  Wants a settlement has been reached you are pretty much done.  Check with the lawyer to see if the case is actually settled since all the paperwork is not signed yet.


  2. In order to receive money you had to agree to settle. Settlement was concreted when you cashed the check. No you cannot go back and sue for more damages regardless of the attorney's signature.  

  3. That would be a very technical point of law. Signing a release is just that, it releases all liabilties of the insured against the insurer. Another point of law is that a person has two years (under MOST state laws) to file for additional medical claims for undiscovered damages. Sit down with your attorney on this. Whether you can reopen the case due to addtional damages is something that cannot be answered in this forum.
