If you take your car for a MOT before the previous one expires and it fails, is the 'old' one still valid

  1. Your car mot is valued until the date it expires , unless you get an unroadworthy certificate issued, then you cannot use it on the public road. It is the same as if you were stopped by a policeman and you had the same certificate  issued by hand


  2. Paul 196 is correct. An MOT is valid until midnight on the date of expiry in all cases. Nothing can invalidate an MOT certificate, not even if the vehicle has been in a massive crash or, as in this case, it has failed a subsequent MOT.

  3. The failure does NOT invalidate the existing MoT certificate, which will remain valid until its expiry date, and may still be used to obtain a tax disk, presented to a police officer upon demand, etc.

    However, if the car has failed because of something which would render it legally unroadworthy, that is a separate issue.   For example, if the fail was for bald tires, then if stopped on the road with those illegal tires you could still be fined for that fault despite still having a valid MoT certificate.

    The MoT certificate merely indicates that the car complied with all the test requirements AT THE TIME IT WAS INSPECTED.  Something could go wrong 5 minutes after you drive away from the inspection.

    Remember also that the requirements for an MoT pass and the legal definition of roadworthy are not always the same thing.

    Example #1:  The speedometer is not part of the MoT test and you can pass if it doesn't work, even though the law demands a working speedo.

    Example #2:  You can fail the MoT test for an ABS warning light showing, even though ABS is not a legal requirement and it is perfectly legal to drive the car in that condition.

  4. The failure takes precedence and anyway, why would you want to risk your life in an unsafe vehicle just to save money?

  5. The old one would be superseded.  Just because your car was road worthy when the current MOT test was done, it is the driver's responsibility to ensure it remains roadworthy.

    As soon as a car fails an MOT test then it is against the law, other than to take it for remedial work and a retest.

  6. As soon as you get your car tested, the new test is valid.  You will be allowed to get your car to a garage (depending on the nature of the failure), and then return it to the test centre.
