  1. Of course, we should clarify that a tenant cannot unilaterally take his name off a lease.  It requires the written consent of the landlord.


  2. If the landlord did not agree to remove your name from the lease in writing you are liable for the lease terms just as much as the person being evicted

  3. How did you take your name off the lease? Was it a sublease to a tenant, or with the landlord directly?

    Landlord and tenant can make any change to the lease that they both agree to. I suppose your tenancy is ending in a shared lease situation, and the landlord rewrote the lease to take you off of it, and got the remaining tenants to sign on.

    If you are off the lease you have no further obligation to the landlord, and that eviction does not affect you.

    If you are part of the eviction, though, it does affect you. Did you receive a notice to pay? Or was it just your roommate that didn't pay her share of the rent? Do you pool your money, or do you each pay the landlord separately?

    Are you even still living there?

  5. The same thing happened to me in college with my loser ex boyfriend.  I took my name off the lease and high-tailed it out, and of course he couldn't pay.  I'm not sure if he broke the lease or got evicted, but it never hit my credit.

  6. As long as the landlord and tenant agree to remove your name before the eviction process, It should not affect you at all. I had this happen to me before. My ex could not pay the rent without me, but the eviction did not fall on me. It fell on him. We all agreed to have my name removed from the lease. 2 months later, he was evicted. I got tired of footing both halves of our rent.
