If you were put on probation for a year & can apply to have the records destroyed?

How do you go about getting them destroyed ? do you just apply to the police station where the charges were laid ? or what

  1. your record doesnt get "destroyed",,only way to have a charge removed from your record is to have it expunged by a judge or governor,otherwise,its there,forever.


  2. In many cases you can have records expunged or reduced say from a felony to a misdemeanor. This is usually done after probation and some time has passed. The case will ALWAYS reside on your FBI record. Even if it is expunged or reduced in many career fields you will still be required to admit the arrest and conviction.

  3. Hello Grace. As noted above, the term you are looking for is called an expungement. The definetion of expunge means to erase as though it never occured, so I will respectfully disagree with some posters above me.

    Two ways to go about a misdemeanor expungement. You can go to the Clerk of Courts in the county of arrest/conviction and ask for the paperwork to file for expungement. Fairly simple forms to fill out. Pay the filing fee and submit the papers. You will not have to make a court appearance for this but will be notified in the mail.

    Second way is to retain an attorney within the jurisdiction of the arrest/conviction. He can draw up your petition and submit it to the court in your behalf.

    Once granted, the records of the arrest/conviction are removed from all public inquiry (background check) and are placed in a seperate area that is accessible only to law enforcement and the courts (this is done for any future repetitions).

  4. You can not have your records destroyed you can have them expunged if you didn't do the crime but sorry it is part of your permanent record

    Don't do the crime if you don't want the time recorded
