Question:

If you witness an accident can you be forced to testify if you already gave a statement to an insurance co.?

i witnessed an accident and i spoke with one insurance company but they 2nd company never contacted me now some lawyer is trying to contact me i was just being a good Samaritan but I'm not trying to go to court in my past experiences these situations usually stop at the insurance company but i think one of these guys didn't have any insurance. Can i be forced to talk to the lawyer.

  1. I think if you gave a statement to the police of what you saw then that should be enough, But if you didn't then they can sometimes subpoena you to court as a witness. And also alot of times all you have to do is just give a statement of what you saw over the phone

You cannot be forced to talk to a lawyer unless your are deposed or subpoenaed.  If you are contacted regarding a deposition, you should attend, you could be fined or held in contempt if you don't.  You should just call the attorney to see what they want.  Usually it is not all that important anyway, just to confirm the accident details.  Nothing to worry about, really.

  3. From my understanding, if you are a witness to an accident - You have to stay and give account of what you saw to the police(especially if death or severe injury is involved). It is a criminal act to leave until that is done.  It is an act or "responsibility".    The insurance companies get their info from the police and the police reports.  You are now a "no-name" witness for your own protection.
