Definitely not.  It could be considered a "no fault accident,"  but that is very seldom the case.  I was struck in the passenger side of my truck by a woman who ran a red light and she was not issued a ticket, although she was at fault.  If it was a one car accident, usually there will be no blame placed on the driver.  If it's a multiple car accident, due to civil law, blame needs to be placed somewhere.


  2. not necessarily, I can't see why....not all mistakes which lead to accidents are illegal, insurance companies could still see someone as being at fault

  3. Nope, your insurance will do all of the investigating and come up with who is at fault.

  4. No, the insurance companies will take statements from witnesses and those involved and make a decision form what every one has told them.
