If youve had a court summons sent for council tax non payment?

do you have up until the date to try and arrange a payment plan with the council or do you have to attend on the summons date?

if you cant phone them right away, can you phone them as long as it is before the summons date.

will they agree to a payment plan? and how can this be worked out?

can you just say ill pay £300 a month?

also will this affect your credit histroy and in what way? is there any way to rectify this?

  1. You have up until the date on the letter to sort something out. A friend recieved one last year and paid it off the day before the court date and there was no ill affects from it. If you want to try to arrange a payment plan you need to phone asap as they have to agree it abd they do not do that immediatly. They will usually agree to a payment plan. You do not have to attend the court hearing unless you think you do not owe anything. The hearing will take place in your absence and you will recieve written info letting you know the outcome.I'm not sure if it affects your credit history, i would imagine that if it goes to court it will though.


  2. As its Council Tax I assume you mean they are seeking a magistrates Court Liability Order.  If so then you have to pay the full amount off to avoid the order.  You can make an offer and ask the Council to withdraw the application if they agree fine make an offer.

    Most Councils continue with the application and then agree a repayment schedule afterwards.  They do this because they cannot enforce the debt without a Liability Order and like you on the hook so to speak

I think if you got a summons you have to arrange it with the court, which I did before the date on the letter, that was ages ago tho, ring the council and ask, 300  quid a month is a more than reasonable offer, they will tell you how best to sort it, or ring the citizens adivce, I have no idea about your credit history tho, good luck with it all.
