Illegal immigrants that entered legally but expired?

I know a friend which entered the country LEGALLY with visas but eventually the visas expired and ever since theyve just stayed in the usa. Along this time, his mom married an american and is undergoing the process of getting a green card. My question is, if the whole marriage thing does not work, how would he go about becoming a legal resident? (Remember, he did NOT enter illegaly, his visa expired and thus made him illegal). Hes over 18 now but he was under 18 when his mom got married.. if somehow the marriage thing does not grant him a green card... what is his option to become a resident?

I also heard that the whole marriage -> green card thing is no longer in work. Is this true? I heard marrying an american legitimaly and passing all the :"tests" will no longer result in a green card .. this whole thing has been taken away?

  1. He is now considered illegal and ICE has now tightened up system where illegals marry Americans-not only will the illegal be eligible for jail time, the American also might.

  3. well, since he was a minor when entering the country he will not having problems about getting the residence card, but his mom possible will. and as long as he is younger than 21 he will get the card easily and fast.
