Illegal parking?????????????

can some-one tell me if it is illegal to park on white lines that have been painted on the road, my neighbour has had 2 of them done on either side of her house even though she has a garage which she parks her car in every night then first thing in the morning whilst still in her nightie she gets her car out & parks it in the space ( which 2 cars could park but she parks in the middle of it) inbetween 1 of the white lines and the entrance to her garage, so in total without counting the part where she needs access to her garage she is taking up 4 places, I hope this gives you an idea (------driveway her car(2places)---------)

  1. Yes it is illeagal and they are enforced by the police and NOT Parking  Attendants. White lines are placed there to prevent blocking of the road and are often seen is residential streets.

    I am a former Parking Attendant. What you need to do is consult first with your local parking authority at the council and follow their advice.

  3. Short answer: If the Highway Authority has authorised the white lines it is a reminder that parking on them is likely to be causing an obstruction or it would be considerate for ordinary motorists to leave the space for someone else.

    More details: Example, white lines either side of a drive way or other access indicates that parking on the white lines will block or make it difficult for someone to turn from the highway. Sounds like this might apply here. Other examples  white lines outside a disable persons home sometimes with the words 'disabled' indicating that motorists should leave the space for the disabled house owners own use or careers visiting.

    It is not a specific offence to park on the white lines but if you do so it is taken as clear evidence that you are causing an obstruction with your motor vehicle and likely to make a prosecution of you easier.

    It is worth pointing out that unless the Highway Authority has made specific parking arrangements or regulations there is no general right to park, the law only says that motorist have a right to 'pass and repass along the highway' therefore every stationary motor vehcile is deemed to be causing an obstruction, some eg. road repairs, funeral cars, post and telephone services etc., more excusable than others. In reality it is therefore normally first come first served.

    In your case it appears the person concerned is able to exploit the fact that only she can park on the white line area as every one else doing so would be obstructing her entrance way. She might be doing it because in the past she has found that even with the advisory white lines other vehicles obstruct the access to her garage. It is not an offence for a person to park across their own drive way, other than the general principle of obstructing the highway. If she has painted them herself the principles of obstruction would probably still apply.

  4. There are several things illegal here;

    1) It is illegal for a private person to "have lines painted" on a public road.

    2) Road markings are prescribed and may not be duplicated, or hampered with by road users

    3) It is illegal to park in such a way that the parked vehicle obstructs a driveway/vehicle entrance, even if it is your own driveway.

    4) Parking bays have a set format and size. Parking in such a manner that the vehicle exceeds that limit is illegal and the vehicle may be towed away.

  5. unless it is a private road, she cant even paint the two white lines on the road.....

    you are not parking illegally unless you are parked OVER her drive and the drive has the "driveway curb stones" you know what i mean, the inclined ones....

    the problem is the law works both ways... if she wants to park on the road, and not in her garage, or on her drive, then she can do..... and if you block her drive (if she has the curb stones) then its you in the wrong...... the highway is public.... whoever gets there first, can park there if its a legal space

  6. check with the city...this sort of thing varies even within cities...and if it is a problem, you could petition the city to force her to use her garage only...if no luck, i'd key her car in the morning...she might start keeping it inside...lol...

  7. That sounds spurious. If you have a dropped crossing providing vehicular access to your property you can request the installation of a driveway informatory marking (a white H line) across your entrance to highlight the fact and to discourage obstructive parking.  Doesn't sound like that, though.

    A driveway informatory marking is advisory only. It has no legal standing.



    I'd speak to your council about it. You cannot go around painting markings on the carriageway willy-nilly.

  9. Not sure what you mean 'my neighbor has had 2 of them done'.  If the city did it, and she is taking up two places, that would seem to constitute illegal parking.  If she is painting lines on the road herself, well, that sounds more like vandalism.

    Question is, why does she do it??????

  11. I would get in touch with your local council and ask them when the lines where put there and what they mean! You also need to let them know that she is doing this and get them to send her a letter of some sort explaining that she can't really do this.
