  1. Yes, and your brother could get in a little trouble as well.


  2. Not in California.  You are underage therefore, you must report back to your residence at the specified time of being your curfew.  You may still be cited regardless of whether you are with your 18 year old brother or not.  Chances are, unless you are just really up to no good, Los Angeles Police Dept. usually has better things to do than cite for a curfew violation.
