Im a Filipino citizen, separated for 6 years but not legally yet. Is it possible for me to get a fiancee visa?

There is a popular program in one of the radio sation in our city that airs problems and response advices by a prominent host - a lawyer and a doctor of medicine. The problem of the sender is similar to me- the sender was sepatared for 5 years and has a foreigner BF that wants to marry her. The advice was- the girl will ask a fiancee petition and once she's already in the US, she then will file a divorce paper for her husband in Phil.. so she can marry her BF in the US.There is no divorce in Phils. Marriage annullment cases on the court takes forever and huge expenses.. Is it really possible for a married Filipina to get a fiancee petition from her foreigner BF? I'm not sure if it's really possible.. Please help me on this coz I also have an American BF that I love so much and wanted to marry me..

  1. No!  you cannot apply for a fiance visa if you are currently married.


  2. No you must have proof of divorce by certified court order to get a fiancee visa to come to USA, a divorce decree that is certified by the court. Also you mustlive outside the USA to even apply for a fiance visa.

  5. If she is not a US citizen yet then the divorce she will file in the US will not be recognized in the Philipines. However, if she has acquired US citizenship already, the divorce case she will file will be recognized by the Philippine government.

  6. No.  It's absolutely impossible for a married Filipino to get a fiance/fiancee visa to the United States.  You must annul your Phlipppine marriage first.

    If you were to get another type of visa, a work visa for instance, that allowed you to establish residence in the United States, you could then get a US divorce and remarry in the United States.

    You cannot divorce in the United States on a Tourist Visa.
