Im an L2 visa holder,employed in India. can i work when i am in US 4the same company thru work from home optn?

I am employed in india i want to continue working for the same company without quitting i will be paid on indian payroll as well as my salary will be subject to tax as per indian tax laws.. i just want to be in US with my husband and continue working from home for the same company. is it possible or for that as well i have to get employment authorization?

  1. You would have to apply for employment authorization to get a temporary job while staying in the US as a dependent.  To continue working for your Indian employer, your employer has to obtain an L1 visa for you to work in their US facilities.

    Note that even though you are paid in India, while residing in the US, you are subject to US income taxes on worldwide income, so you have to pay US tax on that Indian income while you and/or your spouse are residing in the US.  If you and your spouse have not been paying US income taxes properly on worldwide income, you are subject to interest & penalties.  You can also be deported and barred from re-entry for income tax evasion.

    Above reply is not true..!

    - According to the law, you need to pay incom-tax only in one country . There is a treaty between INDIA-US about L1 visa, in which L1 visa holders can have their earning in their home country. For the earning they have in home country they have to pay the incom-tax in home country and NO INCOME_TAX VIOLATION.

    - As far as working on L2, if you are earning in your home country, no need to worry. Just pay the required tax in yor home country.

    - If you are not being paid in US, no need to worry for anything.
