Im getting sue'd for a car accident that didnt happened.?

I got a phone call, and said i got into an accident on jan 22.

i was in court all day (non traffic court) that day, and i had paper proof that i was there. I sent my insurance that information, and now they called me back and said i am getting sue'd . I am so confused and lost,

the other party had all our information, im guessing someone might have picked up my husband's wallet because he lost it early january. What will happen? I have too many things on my plate rightnow, and my friend said just ignore it.? would i go to jail if i dont reply?? or will my insurance just get cancelled? Did any one go through this yet?? thanks

  1. You have insurance!

    Relax.

    It's their job to provide a defense for you.

    Just do everything your insurance company asks of you and you'll be fine.

    They're going to want a statement from you.  Just tell the God's-honest truth about everything and let them handle it for you.

    You've got nothing to worrry about.

  2. I would definitely call your insurance company and put in a claim.  They will go to bat for you...that is what you pay them for.

    Provide them with whatever proof they tell you they need, like the paper work stating you were in court, police report from when wallet was stolen...etc.  They will let you know if they need anything else.

  4. if your getting sued and you go to court, and have papers to prove you were in court all day you should be fine. But don't you have proof that your car wasn't in an accident like..? If they have your info i won't matter, as long as your car is fine your should be all set. The other party seems pretty dumb so go to court then counter sue for false allegations.

  5. You call your insurance company, and give them the information, and let them handle it.  

    They'll defend you.  

    Don't ignore it, or the judgement will automatically go against you.  AND you'll be forced to pay.

  6. I don't understand why you guy's come here for legal advice.  I would contact an attorney right away.  If you ignore a lawsuit, it will be an automatic win for them and you will have wages garnished without notification(happened to a friend).

Don't ignore it.  Contact your insurance agent, it is their job to represent you.  Tell them you know nothing about the accident, and were in court the day of the alleged incident.  They will contact the other insurance company on your behalf, and hopefully that will be the end of it.  If it isn't, they will give you legal representation, and you will not need to hire your own attorney, so please ignore the advice telling you to do that.

    Why would they cancel your insurance for something you didn't do?  You do have a police report showing that your husband lost his wallet, don't you?  That will be helpful.

    Get a lawyer and it will go away real quick - sadly it will cost you some money.  Don't talk to a lawyer and it will cost you even MORE money.

    The insurance will be ONLY interested in their A$$.

  11. Talk to your insuance company. Find out if the "proof" you sent convinced them of your innocence or do the require something further. If they believe you they should defend you against any lawsuit. You might also request a copy of the police report to get the details of what you are accused of.
