Im going to court what to expect?

My ex is taking me to court for visitation with our 3 month old and 20 month old even though he gets to see them whenever he wants to now ,i told him he can pick up our oldest 2 times a week and come to my house anytime he wants within reason but thats not good enough for him i really dont want them to stay the weekend with him i think they are too young and i know for a fact my daughter will be soooo upset without me there for 2 days what will happen at the court date? will i get a chance to present the scheduled visits that i think will work best? what can i expect??

  1. The judge should listen to both sides and may also appoint a guardian for the children.  This guardian will not take custody of them or anything, they are like a court appointed person to assess the situation and recommend what's best for the children.

Depending on what state you live in the parenting guidelines are different I do know that in Indiana, the parents get them for a few hours one night a week then every other weekend, BUT that isn't until after they are two years old and even then the court phases it in.  It is like this in many states, the judge will listen to what each of you think and then he make his decision on what he feels are in the best interest of the child.

  3. He has the right to have them every other weekend or so. He IS the father after all. Its possible that he is just as good and loving a parent as you are.
