Immigrant Marriage Problem Help?

In May, my husband slapped me. I went to the police to file report and the police insisted that he must go to jail. Finally, I decided not to file report to help him.

In July, he harasses me with emails. I'm on process to file divorce in California. I just got the 10 yr permanant resident card in July. He said he'll kick me out of the states because I moved out in Feb (unofficial seperated). What should I do? I don't want any penny from him, but get out of my life! Thank you for your answers.

  1. As long as you have lifted the conditions from your greencard there is nothing he can do to get you kicked out of the country.  Even if you hadn't had the conditions lifted and left him before the 2 yr anniversary of your orignal green card issuance you still would have had a case to get your permanent greencard witout him as there was documented domestic violence involved.  Just try and move on with your life and don't listen to his idle threats, he obviously has no idea what he is talking about!


  2. If you are a legal permanent resident, there is nothing he can do.  You already received you I-551, green card.  You can divorce him today and marry somebody else tomorrow without worry about your immigration status.  

    Even if you were a conditional resident, if you can prove that he was abusive, you will be able to keep your status.
