Question:

Immigrant Visa Priority Date?

I keep hearing about the priority date for immigrant visas that let you know approximately how long you will have to wait before you get your visa.

We filed all immigration paperwork (I-130, DS-230, I-864, medical exam) for my husband here in Tunisia at the US Embassy. From the time of first filing the I-130 to when we will have the immigrant visa interview -next week (where we hand in the I-864 and medical exam) it has taken 6 weeks. I was reviewing his paperwork and it lists a case number and preference category, but no priority date.

Does anyone know how long it will take before my husband would get his immigrant visa?

  1. Sorry about the above post You have cleared the 1st part and you are waiting for an interview right? after the interview at the American embassy it toke us one week to get our visa What they look at is your ability to support your self They don't care about money in the bank, asset, etc they want to know you can support yourself i;e a family of 3 around $26,000 per year  Good luck too you both and welcome

  2. Since you are an American citizen and you've filed an IR-1 petition for him as your spouse, that is an immediate relative petition. It doesn't have a priority date. It's valid for use immediately after it's approved, after the interview takes place of course. Immediate relative petitions do not have any quotas. Others who fall into this are minor children and parents of US citizens.  If your petition had a priority date, say if you were a legal permanent resident filing for your spouse, it would have a priority date, as these preference petitions, or F-21 in this case, take about 5 years before they can be used to emigrate. Had that been the case, the embassy would never have accepted it, because they don't have the space to hold onto papers that long. You are already scheduled for an interview, so not only is there no priority date, you have been able to skip out on 8 or 10 months of processing in the US that others have to endure.

  3. As an American citizen petitioning your spouse there is no priority date.  A visa is immediately available because there's no limit for this category.
