Question:

Immigration or Change of status?

I came in with a fiance visa and have been married for over a year now. Almost 13 months now. So far I don't have a SS#, Work permit or my temporary green card. Is anyone else experiencing this right now as well? My interview was on January 28, 2008. Though the interviewer asked for more information, which was a total catch 22, coz what he needed I needed my temp green card to get a SS# to be able to get a State ID and provide him with these papers. I wrote him a letter stating that what he asked for was totally impossible for the moment. Now, www.uscis.gov stated that if there was anything else, they would contact me. But still nothing. So I'm just wondering how long dO I really need to wait to actually start working and continue my life and not feel so useless. I would expect for them to give the work permit right away, why encourage unemployment?

  1. That is strange, I had my interview in April and the green card arrived 3 weeks later.  If I were you then I would try and schedule an infopass appointment with you local immigration office and see if you can get some answers..... you can do this online at www.uscis.gov   When you call immigration all you get is some person looking at the website telling you what you already know!  Go and see someone face to face and get some answers.... when did you file your paperwork? Did you file all your forms together? I 130, I 485, advance parole (if needed) and work permit application?  The work permit should definitely take less that 3 months from the date of filing your application.  I was married in Nov 2007, filed in Dec 2007, had work authorization and advance parole end of Jan/beg of Feb 2008, interview on Apr 07, 2008 and green card in mail 3 weeks later.... you shouldn't have to wait that long... go and see someone and get some answers, make sure you take copies of all your paperwork and anything you have received from immigration or sent to them since you application.  Good luck!

  2. U may need to see a lawyer to clear up this matter. After your interview your green card should have come in the mail a month later.  If all the information was correct.   One of the things the lawyer can that do  is have them to review your file and notify he or she of any matters that need to be addressed.

  3. Since 9-11, the waiting time has increased because of the need to investigate via several data bases (FBI, et al).

Just be patient;  in a few months you will petition to release the conditional language of your green card, and be afforded full the privileges of becoming a legal Permanent Resident.

  4. If you filed the I-765 along with the I-485 the MUST issue you a work permit after 90 days whether they are done processing the paperwork or not.  You CAN use the work permit to get a Social Security card.  Normally, the work permit will be much faster than 90 days.
