I have recently gained my citizenship for Australia, but I need so advice on the best option to enable my family to come with me to Australia. We currently live in the UK. My fionce and stepchild are not citizens. What options do I have to enable us to live in Australia? I am in the process of adopting my step child so once I have apdopted, will he automatically gain citizenship too? (I gained citizenship through desent) and if so, where would that leave his mother? (my fionce) Would she be entitled to citizenship as her son is a citizen?

Would really appreciate advice and options for us please.

Thanks very much

  1. Go to the Australian visa website. Probably easiest if you get married and then apply. Check the website first. Shouldn't be aproblem. My sister went there on a visa and married an Aussie over there.

  2. Your fiance will not qualify for any automatic means of citizenship. This may be able to get a spousal visa (providing she meets the requirements) but she will not automatically gain Australian citizenship upon her marriage to you.

No she doesn't get a free ride just because she married an Australian citizen or has a son that is one. She's an adult (well I hope she is) and needs to do a bit of legwork as well.

Your soon to be step-son will not automatically qualify for Australian citizenship unless he is legally adopted by you (your name will need to be on his birth certificate). He will need to be adopted in Australia for him to automatically gain Australian citizenship.

  3. I'm pretty sure you'll have to apply for a visa for your stepson, though exactly which one you'd have to check on www.immi.gov.au

Your fiance will have to apply for de facto status to be eligible to migrate. You will have to provide proof of an ongoing committed relationship, ie bills in both your names, joint bank accounts, correspondence during enforced separation etc. I know this for sure because I am a UK born permanent resident of Oz, and am having to do all of the above with my Candian fiance.

  4. just apply for separate citizenships if they arent legally your children. last i checked it wasnt that hard to gain citizenship/permanent residency in other commonwealth countries.
