How impartial do you think a jury can be in terms of its decision-making ability? Do you think that the individual’s attitudes, personality, and beliefs would influence a decision over the facts of a case?

  1. Of course, that's why people are hired to do profiling of juror's for big cases...then as the jury selection proceeds either the prosecuting or defense attorney knows whether to accept or reject a jury member.  Jury rigging is not legal, but profiling of the "perfect jury member" (for defense side) is done frequently.  More importantly is the influence of group, upon decision making behind closed doors...power to reach consensus is strong, and people with low self-esteem are going to bend to the group.....(psychologist)

  2. Of course.  If it were cut and dry we would use an algorithm and a discrete function to compute the conclusion-fact from the basis-"facts"....then we would use a computer to implement the function...

B/c it is not that easy - it follows that it must entail some guesswork (and guess how they fill in the "blanks"?)...
