  1. C

EDIT:  Hamilton had already been dead several years by the time Burr was brought to trial, on May 22, 1807 at the President's insistence, in Richmond Virginia, before the President's cousin, John Marshall, a Virginian like the president.  The prosecutor was the son-in-law of a Jefferson protege, James Monroe.  Despite Jefferson's machinations the jury acquitted Burr and wanted to lock up the government's chief witness.  No one really knows why the Burr-Hamilton duel was fought, but possibly the reason was that Hamilton was suggesting to colleagues that Burr was having an incestuous relationship with his own daughter, Theodosia.  Burr shot Hamilton on July 11, 1804, and Hamilton died the next day.

Burr was acquitted, was not sentenced to death and did not readily admit his guilt.  Therefor, the correct answer remains C, which actually accords with the facts.
