In California, Can landlord break a lease and give 30 day notice to vacate so that he can sell the house.?

Our lease expires in October, we have been signing 6 month leases. This is our second 6 month lease and it expires in this October. But the tenant due to some financial hardships wants to sell the house and gave us a 30 day notice. We have been paying our rent on time and we have no breach of lease. Can the landlord to do this? I know that if you are on a month-to-month lease they can give 30 day notice, but this like they are breaking the lease. Please advise.

  1. In California, you can give 30 days notice to leave but the landlord needs to give a minimum of 60 days notice to kick you out. This is a recent change.

    If they sell the house, your lease goes with the house.  The only way he can cancel the lease before it expires would be if you violate the lease.


  2. Laws have changed a landlord can give 30 days notice. But you must read your contract it will have a clause of how the lease can be broken. Contact your local HUD office they DO NOT like displaced renters!!

    He can not evict you to sell the house unless you do anything to impede the sale, such as refuse to allow it to be shown, in which case YOU brake the lease, not him.

    While he has the right to sell his property he does not have the right to break the lease in order to do so.
