In Indiana how do you prove a BM unfit?

I believe that my partner's ex wife is abusing their child. I have taken pictures of bruises, cig burns, rashes , and just the dirty way she is when we get her. I reported it to police and child services. It has been about 2 months and child services closed the case because they believe that it is just a bad custody battle. I am just the step mother. How can I do anything to get her with out paying out the rear for a lawyer? And if the BM can get past the child services with this behavior what chance do I have?

If the child has bruises and cigarette burns, take her to the doctor. Doctors are required by law to report suspected child abuse. This may get child services' attention when you and your partners complaints do not.
