In MO can you pass a car ,going the same way, at an intersection? If so, when and under what circumstances?

I had my turn signal on, making a left turn, when he hit my front left fender and landed out in the field. He left skid marks 75' before he left the road. His agent said because the police didn't come, and there isn't a report, they are only going to pay half of what they decide the damages are on my car. He said we could exchange ins. info and I beleived he'd treat me like I'd have treated him. I'm a Christian and made the mistake of beleiving him. I have witnesses for my side, but I really don't want to have to take him to small claims court. My witnesses also saw the open container his friend asked him if he should throw in the ditch. He told him to put it back in his car. I was going to the cardilogest and was trying not to miss the appointment. I've never had an accident so I wasn't thinking about calling the cops. I sure will if there is a next time.

  1. ppl try to get smart by not callin  the cops so the insurance dont go up in the end nottin gets resolve and no ones car gets fix you even if the person its agreeing with you that his goin to pay your damages at least call them and let them know that you guys made and agreement you know


  2. What you need to do since you have a witness is tell that to his insurance company so that they will cover you 100 percent and also you can still file a police report so that it will be on file.

    If this does go to court make sure that your witness has signed an affidavit that states what they saw and with only one witness you will win but I really dont think that it will go to court.
