The non-custodial parent has not made any arrangements to see the child at least 8 years and now wants to see the child. The child is 13 and doesn't want anything to do with non-custodial parent. Does the child have the right to decide?

  1. Generally yes, the child can refuse, but the pouse can make a motion to the court saying the reasons why the reconnnection should be allowed...the court might decide to order couseling for both separately and also tiogether. It is a gray area question.

  2. in ky its 12 and h**l yes they have a right to decide. it is them. as long as you are not putting things in thier head. bad things about the other person

  3. I'm in Oakland County. I'm 29 now and unsure if the laws have changed, but at 12 and 13 I was deciding when I didn't want to go spend the weekend with my dad. I never made a permanent decision not to see him anymore, so I don't know if those decisions are different or not.

You can call almost any lawyer's office and have this answered by a professional for free. If you're in Oakland County, you can call the Women's Survival Center for free assistance with this issue.

    Good luck.
