  1. Yes, it is perfectly legal for a LEO to sit in their car while parked and have no lights on while watching traffic. As long as the car is not creating a traffic hazzard there is no requirement to have lights activated. There is no requirement that police have to give you "fair warning" of their pressense, most officers that park with the lights on are doing it to be a visible deterent by reminding drivers that "thay are watching". An officer wearing a refeltive police vest could step out into the road and order you to pull-over and be legal- it's the officer, not the car that's stopping you.

  2. If your car is parked, it can't be pulled over, but he can check you out because he doesn't know what's going on in there and vagrancy is not allowed. You aren't allowed to sleep on the side of the highway.

    If the cop was on the side of the road without it's lights on and you sped by it and it pulled you over, that's legal. The point is to hide from you so you don't slow down. What do you want it to have, searchlights on the top?
