In NY can i terminate child support i have an infant i want to move from ny?

the father of my baby has agreed to let me go i dont need or want his $$... he has his own kids now can i terminate the court order in nys?

  1. In New York State you have two options:

    1) Terminate his parental rights altogether. This will involve filing a petition to terminate his rights and he will no longer have rights to visitation. He will also not be obligated to pay support.

    2) File a child support modification. If he still plans to exercise his rights to visitation then you can just modify the support so that he is no longer obligated to make a payment.

    Either way it is going to be up to the judge. You may want to consider going directly to a court mediator. In most cases you can negotiate the terms of your agreement ahead of time and not have to go through the court process.

    Also consider that even if he is willing to let you go, you still might have to file a custody modification requesting to take the child out of New York. Most of this paperwork is simple enough to complete on your own or your Family Court clerk can give you a referral to an agency that can assist you.
