Question:

In TX when you get stopped for speeding does a police officer have to show you the radar gun if you ask?

I got stopped for speeding. I questioned the officer to the accuracy of his reading, 47 mph on a 30 mph zone. When I asked to see speed device's reading he declined. I asked why and he said he didn't have to. Does anyone know if in Texas an officer can deny your request to inspect the speed device?

  1. He doesn't have to show you the gun.  That's a myth.  He doesn't even need to have a radar gun to cite you for speeding. He can estimate your speed without any device.  What do you think they did before radar guns?

That said, most officers will show you the device if asked.

Finally, think of it this way:  where do you get to draw the line?  Maybe I want to submit the device to my lawyers and have its internal components and programming checked for errors.  It's a speeding ticket; not a murder case.  Pay it.

  2. first time I ever heard that one

  3. i was told you don't have to pay the ticket if you don't get to see the gun. becuase they could just make up a speed. my friend got out of a ticket by asking to see the gun and the police didn't have it on the gun

  4. No, they do not have to show you the reading on the spot.  However, if you challenge the ticket, and they are basing their accusation on the radar, they have to show you (and the judge) the radar printout in court.

Of course, they can also say that they paced your speed.

  5. In Texas, you dont have to show the radar gun because they dont have to.

People can also find out you speed by driving next to you, and seeing what the police are dirving at.

This is not a estimation because its really close to reality.
